Notons quand m\u00eame que le <a href=\"https:\/\/visionarymarketing.com\/fr\/2019\/10\/rgpd-un-an-apres\/\">RGPD<\/a> a d\u00e9j\u00e0 plus de 4 ans. Citons : DMA, DSA, DGA et DA\u2026 n\u2019en jetez plus\u2009! Pour comprendre la situation, Visionary Marketing a appel\u00e9\u00a0<\/i><a style=\"font-style: italic;\" href=\"https:\/\/www.linkedin.com\/in\/pogibert\/\" target=\"_blank\" rel=\"noopener\">Paul-Olivier Gibert<\/a><i>, pr\u00e9sident de l\u2019<\/i><a style=\"font-style: italic;\" href=\"https:\/\/afcdp.net\" target=\"_blank\" rel=\"noopener\">AFCDP, l\u2019association fran\u00e7aise des DPO<\/a><i> [responsables de la protection des donn\u00e9es]. Paul Olivier a r\u00e9cemment \u00e9crit une <\/i><a href=\"https:\/\/visionarymarketing.com\/wp-content\/uploads\/2022\/11\/tribune-dga-da-dma-dsa-vf-1.pdf\" target=\"_blank\" rel=\"noopener\">tribune<\/a> <i>dont l\u2019introduction nous avertissait de l\u2019arriv\u00e9e de r\u00e9cents textes europ\u00e9ens et qui nous a intrigu\u00e9s. Voici donc quelques explications qui, nous l\u2019esp\u00e9rons, aideront les\u00a0marketeurs \u00e0 se rep\u00e9rer dans ce d\u00e9dale l\u00e9gislatif.<\/i><\/p>\n<h2>Un \u00e9tat des lieux de la l\u00e9gislation en cours sur la protection des donn\u00e9es en Europe<\/h2>\n<p>Ces nouveaux textes europ\u00e9ens posent la question de leur articulation avec le RGPD.<\/p>\n<figure id=\"attachment_72665\" aria-describedby=\"caption-attachment-72665\" style=\"width: 540px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"wp-image-72665 size-full\" src=\"https:\/\/visionarymarketing.com\/wp-content\/uploads\/2022\/11\/jumpstory-download20221125-212311-e1669411466610.jpg\" alt=\"Protection des donn\u00e9es\" width=\"540\" height=\"360\" srcset=\"https:\/\/visionarymarketing.com\/wp-content\/uploads\/2022\/11\/jumpstory-download20221125-212311-e1669411466610.jpg 540w, https:\/\/visionarymarketing.com\/wp-content\/uploads\/2022\/11\/jumpstory-download20221125-212311-e1669411466610-450x300.jpg 450w\" sizes=\"(max-width: 540px) 100vw, 540px\" \/><figcaption id=\"caption-attachment-72665\" class=\"wp-caption-text\">Protection des donn\u00e9es\u00a0: \u00ab\u2009Good cop, bad cop\u2009\u00bb\u2026 l\u2019Union europ\u00e9enne met le hol\u00e0, mais la lisibilit\u00e9 de ces r\u00e9glementations n\u2019est pas optimale.<\/figcaption><\/figure>\n<h3>Une \u00e9volution du droit qui suit l\u2019innovation technologique<\/h3>\n<p>Paul-Olivier revient sur l\u2019historique de tous ces r\u00e8glements\u00a0:<\/p>\n<p>Dans les ann\u00e9es\u00a050-60,\u00a0l\u2019informatique est apparue et s\u2019est d\u00e9velopp\u00e9e, pour traiter des informations, les d\u00e9couper en donn\u00e9es qui \u00e9taient ensuite calcul\u00e9es et reconstitu\u00e9es pour donner des informations.<\/p>\n<p><!--more--><\/p>\n<p>Une s\u00e9rie de textes sont alors apparus \u00e0 la fin des ann\u00e9es\u00a070 dont, en France, la <a href=\"https:\/\/www.cnil.fr\/fr\/la-loi-informatique-et-libertes\" target=\"_blank\" rel=\"noopener\">Loi Informatique et Libert\u00e9s<\/a>. La Loi informatique et Libert\u00e9s et les textes europ\u00e9ens ont \u00e9t\u00e9 modernis\u00e9s, ce qui a amen\u00e9 au <a href=\"https:\/\/visionarymarketing.com\/fr\/2021\/05\/rgpd-en-b2b\/\" target=\"_blank\" rel=\"noopener\">RGPD<\/a>, que les marketeurs connaissent bien.<\/p>\n<p>Le RGPD r\u00e9glemente l\u2019utilisation des donn\u00e9es \u00e0 caract\u00e8re personnel, qui peuvent \u00eatre rattach\u00e9es directement ou indirectement \u00e0 une personne physique identifi\u00e9e.<\/p>\n<p>Mais d\u2019autres donn\u00e9es sont produites, relatives \u00e0 une entreprise, \u00e0 des relev\u00e9s physiques, \u00e0 des relev\u00e9s de temp\u00e9ratures, \u00e0 des relev\u00e9s d\u2019informations sur une cha\u00eene de production industrielle.<\/p>\n<h3>R\u00e9guler\u00a0: la mission de la Commission europ\u00e9enne<\/h3>\n<p>Ces donn\u00e9es circulent et la Commission europ\u00e9enne s\u2019est donn\u00e9 pour mission d\u2019assurer une r\u00e9gulation de tous ces \u00e9l\u00e9ments.<\/p>\n<p>\u00ab\u2009Un ensemble de textes est en train de sortir, qui ne sont pas tous au m\u00eame degr\u00e9 de maturit\u00e9.<\/p>\n<p>Le RGPD est m\u00fbr et d\u00e9j\u00e0 vigueur. Ce n\u2019est pas forc\u00e9ment le cas pour tous les autres textes, dont certains ne sont pas encore arr\u00eat\u00e9s\u2009\u00bb,\u00a0explique Paul-Olivier.<\/p>\n<p>Ces nouveaux textes concernent tout le monde.<\/p>\n<p>Leur objectif est d\u2019apporter une r\u00e9gulation pour l\u2019int\u00e9gralit\u00e9 des donn\u00e9es.<\/p>\n<p>Une partie de ces donn\u00e9es sont mixtes, \u00e0 la fois des donn\u00e9es \u00e0 caract\u00e8re personnel et g\u00e9n\u00e9rales.<\/p>\n<h3>Quatre r\u00e9glementations s\u2019appliquent pour la protection des donn\u00e9es<\/h3>\n<figure id=\"attachment_72669\" aria-describedby=\"caption-attachment-72669\" style=\"width: 991px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"wp-image-72669 size-full\" src=\"https:\/\/visionarymarketing.com\/wp-content\/uploads\/2022\/11\/jumpstory-download20221125-210434-e1669412355723.jpg\" alt=\"Protection des donn\u00e9es\" width=\"991\" height=\"880\" srcset=\"https:\/\/visionarymarketing.com\/wp-content\/uploads\/2022\/11\/jumpstory-download20221125-210434-e1669412355723.jpg 991w, https:\/\/visionarymarketing.com\/wp-content\/uploads\/2022\/11\/jumpstory-download20221125-210434-e1669412355723-338x300.jpg 338w, https:\/\/visionarymarketing.com\/wp-content\/uploads\/2022\/11\/jumpstory-download20221125-210434-e1669412355723-768x682.jpg 768w\" sizes=\"(max-width: 991px) 100vw, 991px\" \/><figcaption id=\"caption-attachment-72669\" class=\"wp-caption-text\">4 r\u00e9glementations s\u2019appliquent aux donn\u00e9es\u00a0: DGA\/DA\/DSA et DMA<\/figcaption><\/figure>\n<p>Le\u00a0<strong>DGA<\/strong>, <strong>Data Governance Act<\/strong>, concerne la <strong>r\u00e9utilisation des donn\u00e9es du secteur public<\/strong>, qui sont soumises \u00e0 certaines protections et qui cr\u00e9ent de nouvelles activit\u00e9s, comme les interm\u00e9diaires de donn\u00e9es. \u00c0 cela s\u2019ajoute une notion suppl\u00e9mentaire qui est <strong>l\u2019altruisme des donn\u00e9es<\/strong>\u00a0: vous pouvez d\u00e9cider de partager vos donn\u00e9es pour participer \u00e0 une cause d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral.<\/p>\n<p>Le <strong>DA<\/strong>, <strong>Data Act<\/strong>, a une <strong>vocation plus \u00e9conomique<\/strong>\u00a0: l\u2019objectif est de <strong>maximiser la valeur des donn\u00e9es<\/strong> pour l\u2019\u00e9conomie et la soci\u00e9t\u00e9. Il y a l\u00e0 aussi une optique de favoriser le partage des donn\u00e9es.<\/p>\n<p>Le <strong>DSA,<\/strong> <strong>Digital Services Act<\/strong>, est une <strong>r\u00e9vision de la directive ecommerce<\/strong>, qui touche les services d\u2019interm\u00e9diation. Elle aura des impacts pour les entreprises avec des services d\u2019interconnexions d\u2019acteurs et de plateformes.<\/p>\n<p>Le<strong> DMA,<\/strong>\u00a0ou\u00a0<strong>Digital Markets Act<\/strong>, est la composante <strong>droit de la concurrence en mati\u00e8re de donn\u00e9es<\/strong>\u00a0: cela concerne les contr\u00f4leurs d\u2019acc\u00e8s, les interdictions qui sont li\u00e9es, et les probl\u00e9matiques de comit\u00e9 consultatif sur les march\u00e9s num\u00e9riques.<\/p>\n<blockquote class=\"quote-light\"><p>Dans cette pr\u00e9sentation, je ne suis pas certain d\u2019avoir \u00e9clair\u00e9 tout le monde, mais je suis certain d\u2019avoir expliqu\u00e9 pourquoi c\u2019est compliqu\u00e9\u2009!<\/p><\/blockquote>\n<h3>Des r\u00e9glementations complexes<\/h3>\n<p>Avec ces nouveaux textes, des mots et des notions se recoupent, sans compter les interconnexions avec d\u2019autres r\u00e8glements.<\/p>\n<p>Il faut que tout le monde se mette en veille sur ces sujets. C\u2019est ce fait l\u2019AFCDP pour ses adh\u00e9rents. Elle est ouverte aux DPO, mais aussi \u00e0 leur \u00e9cosyst\u00e8me. Nous sommes\u00a0dans un domaine mouvant, avec des impacts majeurs, des textes qui ne sont pas tous unis et qui ne sont pas faciles \u00e0 coordonner<\/p><\/blockquote>\n<p>Le processus europ\u00e9en est en effet tr\u00e8s complexe.<\/p>\n<p>\u00ab\u2009En France, c\u2019est le Parlement qui vote la loi. Il s\u2019agit d\u2019encadrer un certain nombre de choses, notamment d\u2019essayer de r\u00e9sorber des distorsions de concurrence.<\/p>\n<h3>R\u00e9sorber les distorsions de concurrence<\/h3>\n<p>On a souvent reproch\u00e9 \u00e0 Google d\u2019avoir des produits en concurrence avec ceux de ses clients.<\/p>\n<p>Concernant les comptes Instagram utilis\u00e9s pour vendre des prestations, des r\u00e8gles sont n\u00e9cessaires \u00e0 mettre en place sur la possibilit\u00e9 de transf\u00e9rer les donn\u00e9es, de les r\u00e9utiliser.<\/p>\n<p>Un m\u00e9canisme de r\u00e9appropriation de la donn\u00e9e par rapport \u00e0 l\u2019organisation qui en est la cause est \u00e0 mettre en place.<\/p>\n<blockquote class=\"quote-light\"><p>Le probl\u00e8me de la r\u00e9glementation europ\u00e9enne est qu\u2019elle n\u2019est pas d\u2019intelligence imm\u00e9diate<\/p><\/blockquote>\n<p>On ne peut qu\u2019\u00eatre d\u2019accord avec cela.<\/p>\n<p>Ces r\u00e9glementations donnent l\u2019impression d\u2019\u00eatre disparates, mais elles visent \u00e0 assurer une r\u00e9gulation de l\u2019utilisation des donn\u00e9es \u00e0 l\u2019int\u00e9rieur de l\u2019Europe.<\/p>\n<p>L\u2019intention derri\u00e8re le DSA par exemple est de r\u00e9glementer, sinon de sanctionner de fa\u00e7on stricte et assez s\u00e9v\u00e8re, les fameux GAFAM.<\/p>\n<p>\u00ab\u2009Aucun acteur n\u2019a pourtant la possibilit\u00e9 d\u2019imposer quoi que ce soit \u00e0 ces soci\u00e9t\u00e9s. Il faut essayer de nouvelles choses.
